Change of Use/Conversion Application for Commercial & Residential

This application will be used when the function of a space is to be changed for any reason. This includes commercial spaces where a new or different business is looking to occupy a space. This also includes residential spaces that will be used for business purposes, to include but not limited to Cottage Bakers, salons, certain in-home offices, etc.


Supporting Documents

Please include the scope of business proposed for the space. CT Public Health Code & HVHD policy require that the subsurface sewage disposal system be sized to reflect the proposed use. We may ask for additional information in making this determination.

Other Information

Soil testing and a code complying septic area may be required (CT Public Health Code 19-13-B100a). Approval will indicate compliance with CT DPH Requirements; any other permits required from Zoning, Inland Wetlands or Building Officials are not ensured by this application’s approval.


What is CT Public Health Code 19-13-B100a?

On August 3, 1998, Section 19-13-B100a of the Public Health Code became effective. This code pertains to Building Conversions/Changes in Use, Building Additions, Garages/Accessory Structures, Swimming Pools, Sewage Disposal Area Preservation on lots which are served by on-site subsurface sewage disposal systems. It replaced Section 19-13-B100 which was somewhat narrower in scope but similar in intent.

The purpose of this code is to require that a site assessment be made on those properties served by on-site sewage disposal facilities in order to ascertain whether further development of the property would jeopardize the ability of that property to properly treat sewage waste due to the fact that a code complying septic system could not be placed on the site. The intent is not to determine the present status of the existing leaching system, but to determine that if or, when the existing system fails a septic system can be installed on the property which will meet the needs of the proposed future use.
